FabDep Terms & Conditions

Thanks for choosing FabDep! This document (the “Agreement”) is a legally binding agreement between you and FabDep, a product owned and operated by Debut Infotech, a full-stack Blockchain Development Company registered in India with global imprints in the US and Canada, that governs your use of Fabric Deployer (“Tool”).

The terms “we”, “us”, “our” and “ours” when used in this document relate to FabDep, which includes any parent company, subsidiaries, branches or affiliates under common ownership or control of FabDep. The terms “you”, “your” and “yours” when used in this document mean any user of the System.

Please read these terms of use (“Agreement”) carefully before using the services offered by FabDep (“FabDep” or “we” or “us”). This is a binding agreement between you and FabDep by accessing or using the services in any manner, you agree that you have read and agree to be bound by the terms & conditions of this agreement to the exclusion of all other terms. If the terms of this agreement are considered an offer, acceptance is expressly limited to such terms. If you do not unconditionally agree to all the terms and conditions of the agreement, you may not use the services.

Terms of use

Welcome to FabDep – a cost-effective, intelligible solution that lets users deploy a Blockchain network on-premise or to the cloud with ease and precision. Please continue reading to learn about the rules and restrictions that govern your use of FabDep. This Agreement includes the terms in this document, as well as FabDep’s Copyright Dispute Policy, and the Apple Application Terms.

Will these terms ever change?

We constantly try to improve our Services, so we may update this Agreement as we offer new and improved Services. We may modify this Agreement at any time, but we will do our best to bring this to your attention by posting a notice on the Services or notifying you by email or by some other means. If you don’t agree with the new terms, you may reject them but unfortunately, you will no longer be able to use the Services. Your use of the Services in any way following notification by FabDep constitutes your acceptance of the terms and conditions as modified. We may suspend or discontinue any part of the Services, or we may introduce new features, impose limits on certain features or restrict access to parts or all the Services at any time. We’ll provide you notice when we make a material change to the Services that would adversely affect you.

You represent and warrant to FabDep that:

• All registration information you submit is accurate and truthful;
• You will maintain the accuracy of such information;

• If you’re agreeing to this Agreement on behalf of an organization or entity, you represent and warrant that you are authorized to agree to this Agreement on the organization or entity’s behalf and bind them to this Agreement (in which case, the references to “you” and “your” in these Terms, except for in this sentence, refer to that organization or entity). You also certify that you are legally permitted to use and access the Services and take full responsibility for the selection, use of, and access to the Services, including ensuring that you have permission to communicate with anyone you choose to interact with through the Services.

This Agreement is void where prohibited by law, and the right to access the Services is revoked in such jurisdictions.

Who has access to that data?

FabDep understands that your identifiable information (your phone number, email or your Facebook or LinkedIn login credentials) is private & personal and is dedicated to maintaining its confidentiality and integrity. As such, we will never sell or rent it, and we have policies, procedures, and other safeguards to help protect it from improper use and disclosure. We follow a Minimum Necessary Access Policy, so any required disclosure of your identifiable information is minimized.

Privacy Protection

FabDep’s privacy policies explain how we treat your personal data and protect your privacy when using our Service. By using our Service, you automatically agree to our privacy policies and FabDep can use such data in accordance with its privacy policies.

You must follow any policies made available to you within the Service. You may only use our Service as permitted by law. FabDep may investigate and/or suspend or terminate our Service to you at any time if we find your use of our Service violates the Terms and/or any policies.

Using our Service does not grant you ownership of any intellectual property rights in our Service or the content you may have access to. You may not use any copyrighted content in our Service unless you obtain permission from the content owner and/or are otherwise permitted by law. The Terms do not grant you the right to use any branding or logos used in our Service. Our Service may display some logos, trademarks, or branding materials that are not the property of FabDep. These types of content are the sole responsibility of the entity that makes it available.

You must not abuse and/or misuse our Service, including but not limited to, doing the following things:

• Using the Service for any unlawful purposes or activities;
• Uploading any content to the Service in violation of any applicable law, including but not limited to, intellectual property laws and publicity laws;
• Sending unsolicited promotions or advertisements;
• Accessing or tampering with the Service’s server systems;
• Interfering with or disrupting the access of any user, host, or network;
• Abusing or submitting excessively frequent requests to the Service via the API.

FabDep, in its sole discretion, will determine abuse and/or misuse of our Service.

Limited Liability for Our Service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS AVAILABLE "AS IS". YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

WHEN PERMITTED BY LAW, FABDEP AND ITS SERVICE PARTNERS, LICENSORS, EMPLOYEES, AGENTS WILL NOT BE RESPONSIBLE FOR ANY LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES UNDER ANY CIRCUMSTANCES.

YOUR USE AND/OR PURCHASE OF SERVICE ARE ALL AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” BASIS.

FABDEP DOES NOT WARRANT THAT:

• THE SERVICE WILL MEET ALL OF YOUR REQUIREMENTS AT ALL TIMES;
• THE SERVICE WILL BE ERROR-FREE AND ALL ERRORS IN THE SERVICE WILL BE CORRECTED;
• THE SERVICE WILL BE UNINTERRUPTED.

ALL CONTENT DOWNLOADED, UPLOADED AND/OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER EQUIPMENT OR DEVICES, INCLUDING BUT NOT LIMITED TO, LAPTOP COMPUTERS, DESKTOP COMPUTER, TABLETS, SMARTPHONES, AND SMARTWATCHES, OR ANY DATA LOSS RESULTING FROM DOWNLOAD OR USE OF ANY SUCH ABOVE MENTIONED MATERIAL.

Information Gathering and Usage

When registering for FabDep, we ask for necessary information such as Full Name, Phone, Email, and Organization Name. Your information is only used internally and won't be shared with others.

By accessing or using FabDep, you agree to be bound by these Terms and Conditions. If you object to anything in, or otherwise do not agree to, these Terms and Conditions you are not authorized to use the FabDep tool. You must not use FabDep in any way other than in accordance with these Terms and Conditions.

Your use of FabDep is also governed by the FabDep Privacy Policy and any other terms and conditions contained elsewhere on the FabDep webpage “www.fabricdeployer.com”.
